| 摘 要： | 本文针对法院需要借助医疗行为过错鉴定对医疗纠纷民事侵权诉讼中医疗行为过错进行认定,而现行的医疗事故技术鉴定范围过窄,法医进行的司法鉴定不可避免地存在局限性和片面性,均不能从事医疗行为过错鉴定的现况,笔者提出应扩大目前医学会组织专家从事医疗事故技术鉴定的范围,建立新型医事鉴定制度,增加吸收法医常规参加医疗行为过错鉴定的思考,使鉴定工作与民事诉讼相对接,以利于法院审判,有助于化解争端。
