| 摘 要： | 少数民族民事习惯法治化既是中国法治建设的重要组成部分,也是地方法治建设的重要工程,关系着中国整体法治建设事业能否最终取得成功。因此,论文从立法和司法两个法治化的中心环节上对民事习惯的立法化、司法化路径进行了深入的探析,以期尽快实现少数民族民事习惯与国家民事法制的无缝对接与融合,加快民族地区国家统一法治建设进程。

| Abstract: | The rule of law for minority civil habits not only is one important part of china’s rule of law,but also is the important project of local rule of law;it strongly influences the whole rule of law project of china.Thus,this paper researches the civil habits from the perspectives of legislative path and judicial path.The author hopes that the minority civil habits and national civil legal system will come into merges as soon as possible by those researches,and the process of national unify of the rule of law will accelerate. |
