法哲学的体系和基本范畴论纲

本文是继吕世伦和文正邦两位教授出版的《法哲学》专著之后又一法哲学的体系和基本范畴。包括:法的唯物认识论;法的辩证方法论;法的科学发展观,共二十二个范畴(即章)。截至目前,这是国内外一个全新的法哲学体系和基本范畴,充分体现了马克思主义的世界观和方法论,即在法、法律制度、法律思想中的辩证唯物论和唯物辨证法问题。这个体系和范畴同目前国内公认的法理学体系和范畴完全区分开来,并坚信法哲学将同法理学、经济分析法学、法社会学等成为法学体系中的理论法学的组成部分。

The System of Legal Philosophy and the Outline of Basic Categories

This paper is the system and basic category of another legal philosophy after the monograph ofPhilosophy of Law published by Professor Lv Shilun and Wen Zhengbang.It includes:First,the materialistic epistemology of the law;Second,the dialectical methodology of the law;Third,the scientific development concept of the law,a total of twenty-two categories.Up to now,this is a new legal philosophy system and basic category at home and abroad,which fully embodies the Marxist world outlook and methodology,that is,the dialectical materialism and the materialist dialectic in law,legal system and legal thought.The logic is rigorous,the viewpoint is clear,and the materials are substantial.This system and scope are completely different from the currently recognized jurisprudence system and categories in China,and firmly believe that legal philosophy will be part of the theoretical jurisprudence in the legal system with jurisprudence,economic analysis law,and sociology of law.This paper is academic crystallization of 40 years of author's hard work.
