论我国民间文学艺术作品的版权保护——以中国当代皮影戏的保护为视角

民间文学艺术作品是我国非物质文化遗产的重要组成部分,现有知识产权立法在保护各种智力创作与创造之＂流＂时,却忽略了对＂源＂的保护,而传统知识,尤其是民间文学艺术作品正是当代艺术作品创作之＂源＂,因此,加强我国民间文学艺术作品的立法和司法保护,将有助于保护我国非物质文化遗产的流失。本文通过对民间文学艺术法律保护的现状分析,以中国皮影戏的保护为视角,探求建立我国民间文学艺术作品的版权保护和知识产权立法制度。

On the Protection of Folk Literary and Artistic Works Copyright——From the Perspective of the Protection of Chinese Contemporary Shadow Play

Works of folk literature and art of China＇s intangible cultural heritage is an important part of the existing intellectual property. The current legislations protect a variety of intellectual creation and the creation of the ＂flow＂ while they neglect the source --traditional knowledge, in particular, works of folk literary and artistic works of contemporary art. Therefore, to strengthen our folk literary and artis- tic works of the legislative and judicial protection will help protect China＇s loss of the intangible cultural heritage. The article analyzes the status quo of legal protection of folk literature and art paper, from the perspective of Chinese shadow play, and explore the establishment of China＇s folk literary and artistic works for copyright protection and intellectual property legislative systems.
