| 摘 要： | 依法执政是执政党把握执政规律的重要体现,是加强党的执政能力建设的重要内容,是实现立党为公、执政为民宗旨的客观需要。依法执政的主体是中国共产党,关键是依法授权,核心是依法用权,保证是依法监督。依法执政要求各级党委和领导干部从事执政行为的依据是国家的宪法和法律法规,而不只是或主要是执政党自己的政策;要求执政党通过法定的国家政权组织形式执政,而不是直接通过执政党的组织形式执政;要求执政党应依据宪法和法律确定的国家权力运作方式来执政,而不能打乱国家政权的运作方式。
