谈治安调解实践及法律疏失

公安执法中治安调解被大量适用,但是治安调解范围把握不准确、程序不严谨、调解方式方法简单粗放、调解案卷不规范的情况比较普遍。出现这些情况的主要原因在于有关治安调解的规范性文件存在疏失,主要表现在调解的适用情形、基本程序、文书制作、起算时间等方面的规定过于模糊和粗放,导致警察自由裁量权过大,调解质量不高。因此,应当主要从修订法律和提高警察调解能力等方面提高治安调解水平。

On the Public Security Mediation Practice and the Law Negligence

The "Public Security Mediation" is widely applied in the law enforcement,while the range aren’t accurate grasped,the program is not strict,the mediation method is simple and extensive and the file are not standard.The main reasons for those situations lie in the standard file of the public security mediation that appears negligence,which mainly appears in the application,the basic program,the Instrument making and the time of the beginnings whose regulations are too fuzzy.The result is that the police’s right of discretion is too large,and the quality of the mediation is low.Therefore,we should heighten the level of the public security mediation from the aspect of the law inversion and the heightening of the police’s mediation ability.
