| 摘 要： | 从构成要件该当性、保护法益侵害性、刑法介入正当性等方面进行层进式分析，应当认定居间介绍盗窃者与被害人买卖赃物的行为构成掩饰、隐瞒犯罪所得罪。上游犯罪与掩饰、隐瞒犯罪所得、犯罪所得收益罪合并进行诉讼，能够在全面把握共生犯罪的同时查明派生犯罪的前提性事实，准确认定犯罪，防止出现撼动刑事诉讼法无罪推定原则的情况。将犯罪所得或者犯罪所得收益达到50万元以上理解为掩饰、隐瞒犯罪所得、犯罪所得收益罪“情节严重”的数额标准，具有解释论上的合理性。

| Abstract: | In the point of view of crime elements, law interests violation and justification of punishment, the action of introducing larcener and victim to dealing swags should be considered as a crime. If we combine the predicate offences and the crime of covering and disguising criminal earnings and incomes into one lawsuit, we can analyze the criminal actions accurately. It is reasonable to set criminal amounts standard of execrable character as five hundred thousand RMB for the crime of covering and disguising criminal earnings and incomes. |
