公诉环节程序倒流问题研究——以广东省Z地区三检察院为考察对象

公诉环节程序倒流是由检察机关发动的对案件实体或程序上的补救程序。我国公诉环节程序倒流具有以下特征：实体补救型程序倒流比例过高；程序补救型程序倒流比例偏低且效果不佳；错误规避型程序倒流以较高比例不当存在；等等。上述诸多问题不利于人权保障和实现公诉程序正当化。构建科学、合理的公诉环节程序倒流规则，必须进一步完善退回补充侦查程序，加强检察监督，取消移送单位撤案制度，严格规范撤回起诉的范围和后果。

On the Reverse Procedure in Prosecution Research of Three Procuratorates in Guangdong

The reverse procedure in prosecution which is launched by the procuratorate is the remedy procedure of substance justice or procedural justice. The reverse procedure in prosecution in China includes the following features：the reverse procedure of substantive remedy has an unreasonable large proportion, while the reverse procedure of procedural remedy is very small and produces poor results, etc. The many problems above-mentioned are not conducive to human rights protection and justification of the prosecution procedure. To build a scientific and reasonable reverse procedure in prosecution, we must further improve the procedure of supplementary investigation, strengthen the supervision of investigation, cancel the sys- tem of transferring off the case, and strictly regulate the scope and consequences of withdrawal of prosecution.
