四要件:没有构成要件的犯罪构成

构成要件是三阶层的犯罪论体系的基础,具有其独特的含义与机能。而在四要件的犯罪构成体系中,构成要件被改造成为犯罪构成,成为犯罪成立条件的总和,丧失了构成要件的机能。因此,本文认为四要件是没有构成要件的犯罪构成,应当废弃犯罪构成的概念,重新恢复构成要件的概念,以此建立阶层式的犯罪论体系。
