矿难治理中政府管制失灵的原因及对策选择

“矿难”是我国经济可持续发展面临的重大挑战，亦是我国政府管制的重要议题。矿难治理的困境暴露出煤矿安全生产管理和监督的过程中政府管制失灵，其主要的原因在于管制激励不足、管制体制权责不清、管制的法律权威衰弱。由政府管制失灵原因分析可见，治理矿难不仅要建立合理的政绩评估机制，重塑法律权威，扩大公共参与，转变政府治理模式，还需要引入先进的政府监管技术手段，提高政府监管的有效性。

Analysis and Countermeasures on Government Regulation Failure in Mine Tragedy

Mine tragedy puts great challenge on the sustainable development of economic and becomes the most important issue of governance in China. The main causes to the ineffective governance in the management of mine tragedy are the lack of motivation, the imbalance of administrative power and responsibility, and weak law. According to the analysis of the reasons of the failure of regulation, the author will try to give some policy recommendations which are aim to improve the effect of the regulation of mine tragedy, including establish the proper evaluation system of governance, constitute the responsible administration of government, rebuild the authority of law, encourage fully informed public participation, change the way of governance, and utilize the high technology like GPRS, in improving the effect of governance in mine tragedy.
