| 摘 要： | 本文通过对非法证据排除规则的世界趋势和我国现状的考察 ,对构建非法证据排除规则进行理性思考 ,提出依据权衡原则 ,兼顾人权保障、程序正义与控制犯罪、实体正义的平衡 ,采取灵活、渐进的方式构建我国非法证据排除规则 ,以期在价值取向上排除非法证据 ,在司法实践中尽可能地适用客观真实的非法证据

| Abstract: | Through studying the world trend and our country's situation of the illegal certificate exclusionary rules, and thinking about its constructive conditions, this passage brings out one theory, that is, according to weighing rules, human rights protection, procedural justice, control of criminal and the value of substantial justice, using flexible and gradual ways, to construct it, so that we can exclude illegal certificate in value trend, and can apply the objective and real illegal certificate to judicial practice as possible. |
