In the practice of the criminal procedure law of china,supplemental investigation leads to extended custody frequently.This would not only infringe the human right of the criminal suspect gravely but also have negative influence on the society.Regarding the problems of some judicature illegally taking their post in the practice of the supplemental investigation procedure,the author performs brief studies and discussions in this article and points out how to improve the criminal procedure law and what should be done correctly to avoid extended custody.
