| 摘 要： | 刑罚目的是刑罚理论的核心,对刑罚目的的选择直接影响刑罚的制定、适用和执行。刑罚目的所体现的法的价值理念应与国家所追求的法的价值理念相适应。预防论的刑罚目的理论因其固有缺陷并不符合我国国情,而报应论的刑罚目的理论体现了对正义、公平、保障人权的价值理念的追求,符合我国的法的价值追求,适合我国国情,应当作为我国的刑罚目的。

| Abstract: | The purpose of punishment is the core theory of punishment.The choice of the purpose of punishment affects the establishment,application and enforcement.The choice of the purpose of punishment should be decided by the value of law what the country in pursuit of.Theory of prevention is defectiveness,and lead to many problems.But theory of retribution incarnates justice,equity and human rights,and these accord with Chinese value of law and the situation of a country.It should be the purpose of punishment of China. |
