第三维空间下的准行政行为

准行政行为是行政主体(行政机关、法律法规授权的组织)以外的社会组织在行使社会公共管理职能过程中依法作出的产生行政法律效果的行为。由于公共行政的发展,越来越多的社会组织开始行使公共权力。鉴于这类社会组织的复杂性,从主体角度对其进行分类研究存在一定的困难,准行政行为从权力运作的角度来探讨某些社会公共组织行为的法律定性,有利于进行类别化研究,可以有效解决目前理论上和实践中存在的问题。

The Quasi -administrative Act Under the Three -dimensional Space

Quasi-administrative act is defined as the act with administrative legal force made by the social organization except for administrative body(including administration and authorized organization) when performing public management function. More and more social organizations begin to exercise administrative power with the development of public administration. It is difficult to study these social organizations from body angle. But it is easy to make certain legality of their conducts from authority operation angle at some degree.
