聆询是公安部设立的一种新的劳动教养审批制度。聆询属于广义的听证程序,又是准司法审判程序。聆询的价值主要体现为平衡、平等,公正,效率,廉政等。聆询制度的主要原则是公开、公正、职能分离、事先告知等。从执法实践看,聆询制度尚存在着原则要求、根本目的、价值宣传、程序作用等方面的缺失。在实践环节完善聆询制度的途径是加大聆询宣传力度;增强民警人权意识;保证聆询公正透明;建立聆询效力制度。

Uncovering the Veil of Investigative Hearing: Values, Principles, Loss and Perfection

Investigative hearing is a new approval system of re-education through labor set by the Ministry of Public Security.It is part of generalized hearing procedure and a quasi-judicial proceeding.Its value is mainly characterized as balance,equality,fairness,efficiency,and the independent commission against corruption.The main principles of the investigative hearing system are openness,fairness,division of functions,prior notification,etc.From the enforcement practice,the system of investigative hearing is still incomplete in principle requirement,fundamental purpose,propaganda of value,procedural function in practice. There are ways to perfect the system of investigative hearing: to step up propaganda on investigative hearing;to enhance police awareness of human rights;to guarantee fairness and openness of the system;to establish the effectiveness of the system.
