| 摘 要： | 习惯和操作规程证据规则作为证据法上相关性理论的重要组成部分,在我国并没有得到证据法学界的重视。美国对习惯和操作规程证据的使用已有了相对成熟的规定,我们有必要对其进行研究以吸收其内在合理性因素,以期对我国司法实践产生积极的影响。

| Abstract: | As an important part of the relevance theory in the law of evidence,the rule of Habit and Routine Practice has not been paid enough attention in China.In American legal system,the use of evidence of habit and routine practice has been given mature provisions.We need to study it in order to absorb its intrinsic rational factors,which provide good experiences for Chinese practice. |
