| 摘 要： | 公司相互持股现象是公司企业的商业文明在 2 0世纪飞速发展的产物。它的出现和存在既有其积极因素 ,也有其消极因素。各国公司法依据本国的具体情况对公司相互持股问题采取了不同的立法模式。我国现行公司法对公司相互持股问题未作规定 ,应借鉴成功作法 ,建立和完善对公司相互持股进行法律规制的制度。

| Abstract: | Companies holding other companies' stock is a creation of enterprises and the product of rapid development of companies in the 20th century.This has advantages and disadvantages as well.Company laws regulate this with different patterns of law in accordance with their own countries' circumstances.The company law of our country does not say anything about it and ought to make laws concerning the issue by making references with the foreign laws. |
