我国对侦查辨认程序的相关立法简陋,立法层级低,立法规范性差。通过立法明确界定侦查辨认结论的法律地位,在完善我国侦查辨认程序时,应当对侦查辨认结论设置相关配套的法律规定,确保非法获取的侦查辨认结论得到合理排除。增加侦查辨认的形式,完善侦查辨认规则体系,完善侦查辨认程序的权利保护机制,进行侦查辨认必须进行全程录音录像。
