经济犯罪侦查中行政执法与刑事执法的街接机制

目前我国经济犯罪侦查中的行政执法与刑事执法衔接机制建设正处于起步、探索、完善阶段,从这一机制的运行效果看,还是值得肯定的,这也充分证明了建立行政执法和刑事执法衔接机制的必要性和可行性.但是,在关注良好效果的同时,我们也应该清醒地认识到行政执法与刑事执法衔接机制运作过程中存在的不足,主要表现为以罚代刑现象普遍存在、涉嫌经济犯罪缺乏明确的法律标准、对经济案件移送的监督缺位等.构建完善的衔接机制必须从多角度来探讨,即经济犯罪侦查中执法衔接的前提、关键及核心.
