“国有资产授权经营”制度的剖析及其重构

我国当前经营性国有资产所采取的两级制和三级制的授权经营模式，无论是理论上，还是实践中，都存有较大问题。为此，我们应重塑现行的“国有资产授权经营”体制，明确区分国有资产出资人的管理职责与出资人的经营职责，将政府定位为国有资产出资人代表，特设国有资产经营公司，专事经营性国有资产的投资运营，重新界定国资监管机构的法律定位，使其真正成为国有资产经营的监管机构，将国资监管机构与经营公司的关系明确为监管与被监管关系。同时，按市场化原则运作国有资产经营公司，并将国有资产授权经营法律关系的内涵界定为行政授权关系，以此理顺经营性国有资产的管理体制。
