| 摘 要： | 商标淡化理论起源于美国的学术探讨以及德国的判例理论 ,在一些国家得到了立法认可。其理论的基本内核在于欲彻底地保护商标权人的利益 ,突破了传统混淆理论的限制。这与商标功能重心的变迁密不可分。
