| 摘 要： | 近代自然权利学说的兴起,促成了近代宪法的产生,引起了权利宪法化的广泛立宪运动.先验式权利与经验式权利是权利完法化的两种权利来源.而成文与不成文成为权利宪法化的两种基本实现方式.
