我国事实婚姻问题的婚姻法规制

我国历次婚姻法均没有关于事实婚姻的规定。实践中,非依婚姻登记而成立的婚姻普遍存在,并不断引发纠纷。法律的空白和司法解释的不确定性,使事实婚姻问题难以得到合理解决,难以为当事人提供适度的人文关怀,不利于婚姻家庭的稳定与发展。我国婚姻法应该首先改革我国的结婚形式要件,缩小事实婚姻的范围。其次将欠缺婚姻成立形式要件的事实婚姻明确定性为无效婚姻,用无效婚姻制度平衡各项法益。

Suggestion on solving the problem of de facto marriage by marriage law

Chinese marriage and family laws never regulate the system of de facto marriage.However,the de facto marriage,in fact,exist ceaselessly and give rise to dispute.This article definited the concept of de facto marriage at the level of law,put forward concrete legislation proposal to control fact marriage question by our country marriage and family law.First,reforms marriage form document,confess the marriages which set up according to tranditional custums to reduces the number of fact marriage.Second,put de facto marriage into the systerm of invalid marriage.
