| 摘 要： | 用益权作为用益物权的一种重要类型 ,为西方国家所固有 ;现代用益权较之传统用益权在客体、内容、基本功能等方面都发生了较大的变化。我国民法可以借鉴用益权这个“壳”规定企业用益权、自然资源用益权、空间用益权。

| Abstract: | As an important kind of usufructuary right, usufruct is already existed in west countries. Compared with the traditional usufruct, modern usufruct has changed greatly in such aspects as object, content, basic function and others. The usufruct can be used for stipulating the enterprise usufruct, natural resource usufruct and space usufruct in Chinese civil law. |
