中国自由贸易协定知识产权范本建设研究——以应对TRIPS-plus扩张为视角

中国自由贸易协定知识产权制度建设在取得积极进展的同时,仍然存在着明显的问题与不足。在当前贸易协定TRIPS-plus规则盛行的语境下,我国应当加强对策研究,理性选择知识产权条款。有必要建立形式稳定、内容明确的自由贸易协定知识产权范本,以宣示立场、统一文本、把握主动权。在FTA知识产权制度设计方面,必须进行合理的目标定位,坚持阶段适应原则、公共利益原则和整体利益原则,变现有的松散合作模式为关注优先事项的点面结合模式。

Making a Model of Intellectual Property Chapter in Chinese FTA:In Response to Proliferation of TRIPS-plus

Though in China great progress has been made as to intellectual property protection while negotiating FTAs,there exist still problems and insufficiency.As such we should endeavor to study countermeasures and make rational choices of intellectual property protection provisions in the present context of proliferation of TRIPS-plus agreements.It is also necessary for us to make a model chapter with consistent formality and explicit contents for the FTA so as to have our attitudes declared,FTA texts uniformed and initiatives not lost.While designing the FTA intellectual property protection system,we should have reasonable targets,comply with principles such as stage adaptability,public interest and the overall interest,and replace present loose cooperation method with integration of focusing on priority and caring for general issues.
