| 摘 要： | 司法部在2008年宣布在校大三学生可以参加司法考试。笔者通过对作为显学的法学和法学家们对法学教育问题的集体失语的检视，揭示了当代法学教育人文精神困顿和高等教育发展方向的背离。在讨论了司法考试对大三学生开闸后对大学法学教育生态的影响后，笔者认为司法部这样一项政策安排对法学教育的影响是负面的，应该及早停止。

| Abstract: | Ministry of Justice announced that the third year college students are qualified to take part in the judicial examination in 2008.By examining the position of law in current society and the silence of the legal academic profession on the legal education issues,the author points out that the contradiction of the legal education and the development of higher education.After analyzing the influence of adopting this policy,the author argues that the effect of it is negative and should be abolished in time. |
