| 摘 要： | 1997年修订的《中华人民共和国刑法》专门增设了侵犯商业秘密罪，将商业秘密纳入到刑事法保护范畴。该罪在适用过程中遇到了很多问题和争议，也不符合TRIPS协议中有关规则。本文立足于我国现行刑法的规定，对商业秘密的概念、犯罪客体以及司法认定等相关问题予以探讨，以期为司法实践提供一些有益参考。

| Abstract: | The crime of infringing trade secret is added into Chinese Criminal Law in 1997,which put trade secret into the criminal protection.There are many problems and disputes in the application of it,which are not matched with regulations of TRIPS agreement.Based on our present regulations in criminal law,the paper studied the concept of trade secret,criminal objects and some problems on judicial determination in order to provide some beneficial references for judicial practice. |
