| 摘 要： | 著作权法关于侵犯著作权行为的规制,被刑事立法吸收为侵犯著作权罪。从渊源关系上看,著作权法是被吸收法,刑事立法是吸收法,吸收法应以严重的社会危害性为尺度全面吸收被吸收法中关于侵犯著作权行为的规定,同时当被吸收法已经对相应的侵权行为作了较大的修正时,刑事立法也应通过修正案及解释的方式进行相应的修正。
