| 摘 要： | 古今中外的刑法史上,通奸通常被规定为犯罪,并且课以严厉的刑罚。但随着现代文明的进步,刑法在加强打击法定犯的同时,逐渐退出公民个人的私生活空间,让位于其他法律和道德规范。刑法的“有所为而有所不为”正是现代法治的要求,由此就不难理解现代社会中通奸行为的“非罪化”。

| Abstract: | Adultery has always been criminalized and sternly penalized in both Chinese and other foreign country's ancient and modern criminal law history. But with the proceeding of modern civilization, criminal law has withdrawn from citizen's private area gradually as the same time as it enforced administrative crime striking and gave way to other laws or morals. Both the criminal law's active and passive action is the demand of modern "rule by law". Since then, we can understand adultery's decriminalization without any difficulty. |
