| 摘 要： | 诉讼证明本质上是一种思维活动,诉讼证明的对象可分为两种最基本的形式:法律事实的证明和法律关系之证明,而法律事实的证明又有赖于客观事实的证明和心理事实的证明。证明对象不同,其相应的证明方法也不同。客观事实的证明遵循的是自然科学规律,而心理事实的证明遵循的是思维规律。

| Abstract: | The lawsuit proof is essentially a thinking activity.The subject of the lawsuit proof can be divided into two basic forms: the proof of the facts of lawsuits and the proof of the relation of the lawsuits.The proof of the facts of lawsuits depends on the proof of the objective facts and psychological facts.If the subject of the proof is different,so is the corresponding method of the proof.The proof of the objective facts follows the rules of the natural science,while the proof of the psychological facts follows the rules of thinking. |
