析贷款诈骗犯罪司法适用问题研究

随着我国贷款金融业务的日益发展,诈骗贷款违法犯罪活动也随之产生并愈益严重。同时,贷款诈骗犯罪呈手段多样化、智能化、复杂化的发展趋势。在司法实践中认定本罪常常涉及到对该犯罪的主观方面（非法占有目的）,主体范围等热点和难点问题如何理解的问题,因此,本文试图运用刑法理论,结合刑法的规定,对有关贷款诈骗罪的司法适用问题作些探讨,以期对司法实践部门办理此类案件有所帮助。
