论刑讯逼供的防范对策

在现代司法文明时代，刑讯逼供日益被司法界所重视，并采取了一系列措施，但仍屡禁不止，究其原因是多方面造成的。文章从刑讯逼供的原因出发、对症下药，确立无罪推定，完善证据尤其是口供的采信规则，改革侦查体制等立法、司法实践方面的措施，以期减少乃至消除刑讯逼供，从而裨益于构造公正、文明的司法程序，实现司法公正，落实“依法治国”方略。

The Countermeasures for Extorting a Confession by Torture

Recently,the issue of criminal judicial justice has drawn more and more attention.In modern judicial practice,extorting a confession by torture is paid attention,though measures are taken to prevent it,it happened frequently.The reasons are many-sided.Starting from the causing reasons,this paper puts forward the measures of the implement of ideology of presumption of innocence,perfecting the rules for accepting evidence,strengthening legal constrains on criminal case investigators,which hopes to reduce and even eliminate extorting a confession by torture,and to be helpful to the establishment of fair and civilized judicial procedure,to realize judicial justice and the general plan of administering a country according to law.
