从“法内说法”到“法外说法”——军事法学研究范式的当下转型

我国军事法学经过30年的繁荣发展,初步构建了完整成熟的学科理论体系,但研究中移植复制一般法学理论成果的痕迹明显,对军事法的＂个性＂或特殊规律性的揭示不足。未来军事法学的理论创新,在运用法解释学和法社会学方法继续＂法内说法＂的同时,需要将研究视角转向法外,即借助其他学科的知识深化军事法的研究,通过＂法外说法＂进一步对军事法的特殊性进行全新理论阐释和重构。

From the ＂Inner Law Research＂ to the ＂Externe Law Research＂ the Current Conversion of the Military Law Research Approach

Military law in our country has constructed the full and mature knowledge theory system after thirty years flourishing de- velopment, but the central problem in the research is the mode of explanting or copying general law theory production, in other words, the research to the ＂personality＂ or the special essence of military law is not enough. In the future, the scholars should pay more atten- tion to the transformation of research approach. On the one hand, we should continue to research military law by the method of hermeneutic and sociology. On the other hand, we should reexplain and reconstruct the special essence theory of military law in virtue of all kinds of knowledge of other subjects from the externe law visual angle.
