| 摘 要： | 缔约过失责任是否一种独立的民事责任,我国学界颇有争议。笔者认为,缔约过失责任与违约责任、侵权责任、不当得利和无因管理责任共同构建了我国民事责任体系。缔约过失责任制度在我国处于起步时期,其相应的法律制度还有待完善。

| Abstract: | It is still quite controversial in our national academia whether the liability of culpa in contrahendo is one kind of independent civil liability.The author believes that liability of culpa in contrahendo together with liability of breach of contract,tort liability,unjust enrichment liability and liability of officious meddling constitutes the civil liability system in our law.The liability of culpa in contrahendo rule so far has just been at its early stage in our country.Its corresponding legal system also waits for further consummation. |
