政府干预的权力边界研究——以消费者选择权为分析视角

政府干预的边界止于何处,学术界众说纷纭。基于消费者选择权对政府干预边界进行的解释是一个新的学术尝试。消费者的选择权可以分为三个层次:完全选择权、限制性选择权和无选择权。消费者选择权的实现程度是政府干预权力边界的表征。消费者具有完全的选择权意味着政府应远离微观市场,消费者具有限制性的选择权意味着政府的监管以及反行政垄断的任务,而在消费者无选择权的情况下,政府干预就没有边界。保障消费者在出租车市场中的选择权,一方面要培育新的竞争主体,另一方面要多用法律工具和信息工具,慎用经济工具和行政工具。

Bounds of Government Intervention:An Analysis of Consumers' Self-choice

No academic decision has ever been reached though much has been debated about the bounds of government intervention.It might be a new passage to solve the issue from the angle of consumers'self-choice. Consumer self-choice per se can be divided into full self-choice,limited self-choice and without self-choice.To what extent consumers may assert their self-choice will well betray the fact that to what degree the government decides to intervene.Consumers'enjoying full self-choice indicates the government's being far away from micro-market while limited self-choice indicates government's regulation and antimonopoly.Further,while consumers'having no self-choice implies the government interfering in everything.To protect consumers'selfchoice in taxi market,say,one should encourage new business to participate in competition and prefer legal and informational apparatus rather than economic and administrative tools.
