| 摘 要： | 长期以来,我们对法律推理的研究多限于以逻辑为基础的研究,这是一种法律形式化主义面孔的刻画,法律推理中价值判断具有必然性。法律作为人类实践理性的产物要求我们必须认真地对待法律推理中的价值判断。对法律推理的性质和过程进行初步的探讨,并对法律推理中基于对法律解释和案件事实的价值判断两个角度进行分析,有助于我们认真地对待法律推理中的价值判断问题。

| Abstract: | We are confined to the research taking logic as the basis to legal analogy so far,this is one kind of legal formalism.And the value judgment has certainty in legal analogy.The author made a preliminary investigation to the character and process in legal analogy,especially in the two angles of legal interpreting and fact of case and claimed that we must treat the legal analogy seriously. |
