关于建立我国社区矫正制度的思考

社区矫正,是指以社区为基础,把符合一定条件的罪犯放在社区,参加有偿或无偿的社会劳动,由专门的国家机构,在相关的社会团体、民间组织的协助下,在判决或裁定确定的期限内,矫正其犯罪意识和行为恶习,使其顺利回归社会的非监禁的刑罚执行活动。在我国,社区矫正制度还没有完全建立,不过在我国刑罚制度中已经规定了一些社区矫正措施。但是,这些措施的执行却往往流于形式。为此,必须建立并完善社区矫正制度,提高认识、统一思想;设立专门机构、配备专职人员;修订有关法律、完善法律制度。

Thoughts on Establishing Community's Correctional System in Our Country

community's correction means the non-imprisonment executive activity of punishment, which basing on the community, criminals who accord with certain conditions can live in the community, take part in paid or unpaid social work, and with the assistance of relative social groups and folk organizations, within the judgment limitation, special government office will correct criminals' guilty knowledge and bad habits and make them return back to society successfully. In our country, community's correctional system hasn't established wholly, but there are some community's correctional measures in our country's system of punishment. And the implement of these measures becomes a mere formality. So we must establish and perfect community's correctional system, deepen our understanding and seek unity of thinking; establish special organization and equip fulltime staff; revise relative laws and perfect legal system.
