| 摘 要： | 现行的农村集体土地制度存在着土地所有权主体错位、土地所有权权能不全等弊端。由于这些弊端的存在,使农民不能充分利用土地,农民的利益得不到充分的保护,因此,如何克服上述弊端使农村集体土地所有权制度科学化成为制定中国民法典过程中所必须解决的重要问题之一。

| Abstract: | The current rural collective land system has many drawbacks, such as the subject of the land ownership misplaces, the ownership of land and its functions are incomplete, etc. Owing to these, farmers cannot fully utilize their land, and their interests cannot be gotten abundantly protection. Therefore, it become an important problem how to overcome the above-mentioned drawbacks and make the ownership system of the current rural collective land more scientific in the process of making the civil code of China. |
