| 摘 要： | 当代中国正步入全面的转型期，当代中国监狱也随之进入了转型期，监狱的转型本质上就是监狱文化的转型，而监狱文化的转型首先出现的是监狱文化的冲突。当代中国监狱文化的冲突主要表现在三个方面：传统与现代的冲突；本土与外来的冲突；人治与法治的冲突。

| Abstract: | Contemporary China is entering a comprehensive transition, and contemporary Chinese prisons have also entered a transition period. Prison is the essence of the prison culture in transition, and the prison culture in transition is the first of the prison culture of conflict. The contemporary China prison culture＇s conflict mainly displays in three aspects： the conflict between traditional and modern; local and foreign conflicts; the rule of man and the rule of law conflicts. |
