| 摘 要： | 证券内幕交易是我们关注的一个社会热点，但在我国理论和实践的层面大多停留于对证券内幕交易行为的责任追究，而忽略了对证券内幕交易受害人的损害赔偿，致使我国证券内幕交易法律规制体系中私权救济手段空缺。针对我国证券市场刚刚起步，证券法律、法规不尽完善的现状，在立法上强化内幕交易的私权救济机制，构建内幕交易损害赔偿制度，无疑具有重要的理论和现实意义。

| Abstract: | The inside transaction in security has become one of the social hot spots,whose accountability has attracted more attention than the victims' damages,which results in the vacancy of the means of compensation in our country's law of transaction in security.Because the stock market has just started,and the legislation of security has not improved,it undoubtedly has great theoretical and practical significance to strengthen the relief system of insider trading mechanism,and build the compensation systyem. |
