WTO争端解决机制中报复措施的缺陷及革新路径探析

世界贸易组织(以下简称WTO)争端解决机制中的报复措施被认为是解决成员方之间贸易争端的最后手段。尽管它比GATT相关规定有了不少改进之处,但其文本规定上的不足和本身所固有的功能性缺陷仍使得它备受批评和争议。国内外学界对此提出了各种改进建议,有必要对这些建议的合理性和可行性进行深入分析,在此基础上,结合我国的国情探讨我国应持有的立场和对策。

On the Deficiency and Improvement Approach of Retaliation in WTO Dispute Settlement Mechanism

Retaliation is considered as the last remedy in WTO Dispute Settlement Mechanism. Although there is a great improvement in WTO compared with GATT, the provisional and functional deficiencies of retaliation are condemned by many member countries. This paper analyses many improvement measures about retaliation and presents some suggestions with a consideration of China's situations.
