论表面的构成要件要素

刑法所规定的某些构成要件要素,并不为违法性、有责性提供根据,只是对犯罪分类起作用,这类要素属于表面的构成要件要素;合理确定表面的构成要件要素,对于理解犯罪之间的关系、解释事实认识错误、解决共犯过剩现象以及处理事实不明案件具有重要意义;承认表面的构成要件要素并不违反罪刑法定原则。

some elements in constitutional requirements in criminal law do not play the role of providing the basis for illegitimacy and responsibility,but of helping the classification of offences only.This kind of elements is called superficial elements of constitutional requirements,the reasonable certainty of which is of great meaning to catch the relations between crimes,interpret the cognition errors of facts,deal with the phenomenon of accomplice surplus and settle the cases of non liquet.It will not violate the principle of "nullum crimen sine lege,nulla poena sine lege" when the concept of superficial elements of constitutional requirements is accepted.
