| 摘 要： | 本文立足罪名,对巨额财产来源不明罪的犯罪构成进行了剖析。认为该罪侵犯的客体是国家工作人员纯洁性;客观体现为状态犯,而非行为犯;主体只能由纯正的身份犯构成;主观属有特定内容的直接故意。

| Abstract: | Through analyzing the crime of holding a huge amount of property with unidentified sources in terms of the crime itself, the article believes that the object of this crime infringement is the state staff's purity, which objectively manifests the standing crime not the non-behavior crime; and the main body can only constructed by the pure status crime, which subjectively implements the actual intent with specific content. |
