| 摘 要： | 在刑事诉讼领域内关注和保障被害人权利,其意义在于:关注和保障被害人权利是人权保障的必要内容;关注和保障被害人权利是诉讼公正的基本要求;关注和保障被害人权利是惩罚犯罪的重要条件。我国对被害人权利和诉讼地位的法律规定取得了一些突破,但也存在一些缺陷。被害人权利对侦查的影响表现在对侦查权启动的影响、对侦查程序诉讼性质的影响,以及对侦查方式的影响等。

| Abstract: | The significances of researching criminal victim＇s right in criminal justice are： criminal victim＇s right is one of necessary contents of guarantee of human rights;guarantee criminal victim＇s right is one of the basic requests of judicial fairness;criminal victim＇s right is one of the important conditions of punishing crimes.There are many provisions about criminal victim＇s right protection in international treaties and Chinese laws.However,there are some deficiencies.The influences of criminal victim＇s right on investigation are： the influence on investigation＇s start;the influence on the characteristic of procedure;the influence on investigation behavioral. |
