| 摘 要： | 案例指导制度强调"指导",目的在于当法官审案遇到成文法规定得不够清晰又暂无法律可依的情况时,使其可以有所借鉴,这显然不是要求以判例作为法律依据的。案例指导制度对审判实践具有重要的指导意义,其可以弥补成文法的不足,限制法官的自由裁量权,节约司法资源。
