论未成年人财产监护职责的完善

我国目前尚未建立系统完整的未成年人财产监护制度,虽然《民法通则》等相关法律均对未成年人监护作了相应规定,但多为原则性规定,缺乏可操作性,且在监护能力、监护职责、监护责任、监护的终止、监护的监督、监护事务的有关程序等监护制度的基础和必备内容方面都存在着疏漏和不足。本文仅针对我国现行监护制度在财产监护职责上的立法缺失,借鉴其他各国或者地区在财产监护方面的经验及其做法,在区分父母与其他监护人对未成年子女的财产监护职责、明确规定父母对未成年子女财产的监护职责、明确规定其他监护人对未成年人财产的监护职责等方面提出完善我国财产监护制度的建议。
