| 摘 要： | 本文以现行刑法和文物保护法为依据,针对文物盗窃犯罪行为的特殊性,根据刑法的基本理论,就文物盗窃犯罪行为独立设置为盗窃文物罪,以及盗窃文物罪的犯罪构成,盗窃文物罪的刑罚设置及其适用阐明了笔者的观点。

| Abstract: | In this paper,as the basis of the existing Criminal Law and Law for the Protection of Cultural Relics,the author,according to the Criminal Law's basic theory,focus on the unique of criminal behavior of stealing cultural relics,and clarifies author's views about the criminal acts of stealing cultural relics,the crime constitution of the larceny of cultural relics,the setup and application of the punishment of larceny of cultural relics. |
