| 摘 要： | 立论于我国检察机关的法律监督一元论而对我国检察机关的公诉权、侦查权、侦查监督权、审判监督权和执行监督权等检察权的权能进行法律监督权的解析,这使我们看到每一项法定的检察权权能都是法律监督权的具体表现形式,检察权的全部权能在性质上都应当统一于法律监督权．从而证明我国宪法第129条对检察机关是国家法律监督机关定位的科学性。

| Abstract: | Based on the monism of the legal supervision by the procuratorial organs in China, making an analysis on the functions of the procuratorates such as the power of prosecution, the power of investigation, the power to supervise investigation, the power to supervise adjudgement, and the power to execute supervision, we can see that the every legal functions of the procuratorates are special forms of the power of legal supervision to which the former are by nature reduced, therefore it is scientific for the Article 129 of the Chinese constitution to orient the procuratorates as the national organs of legal supervision. |
