| 摘 要： | 刑事人身检查作为一种重要的侦查方法，其运用常常给被检查人的基本权利造成一定程度的侵犯，域外各国立法大都对刑事人身检查制度进行了比较全面的规定。我国刑事诉讼法对刑事人身检查的规定存在着缺失与不足，有必要审视域外其他国家有关刑事人身检查制度的立法经验，结合我国国情加以比较、借鉴，以完善我国的刑事人身检查制度。

| Abstract: | As an important means of investigation, criminal physical inspection often leads to the violation of the basic rights of the person being investigated. Most of the legislations in alien countries stipulate in a fairly comprehensive way the system of criminal physical inspection. There exist deficiencies and drawbacks as to the provisions of criminal physical inspection in China. Therefore, it＇s a necessity to examine the relevant legislations in alien countries by combining the current situations in China and perfect the system of criminal physical inspection in China. |
