论矿业权的法律属性

矿业权以国家对矿产资源的所有权为基础,是一项私权,是财产权。矿业权作为一种特殊的物权,其在法律属性上更加接近于用益物权,故可以准用《物权法》中关于用益物权的相关规定。但鉴于其又有别于传统民法中的用益物权,且又具有较强的公权色彩,所以又被称之为"准用益物权"。《物权法》对矿业权准用益物权属性的认可,也有助于我们正确把握矿业权调整中的双重法律关系。

On Legal Nature of Mining Right

Mining right is a private right and property right based on the ownership of mining resources by the state. As a special jus ad rem,mining right is more like usufruct. Therefore,we should apply relative provisions on usufruct in jus rerem.
